For organizations looking to hire in Belarus, the first step is to understand the employment laws and labor code of Belarus. Employment contracts can be drawn up for an indefinite term, a fixed term, or for a temporary period. Regulations are often updated and there were several amendments made to the country’s labor code in 2020. There has been a recent addition to the code of a new section (Section 25-1) covering the approach employers must take with regards to remote work.

The following are only guidelines in the broadest sense, and professional legal services are recommended when employing in Belarus.

Minimum Wage

In Belarus, the minimum wage is 400 Belarusian Rubles per month in 2021.

Payroll Cycle

For customers of Remote, all employee payments will be made in equal bi-monthly installments, payable in arrears.

    • Income for Belarusian employees is generally taxed at a flat rate of 13% (there are a small number of specific exceptions).

Types of leave

Statutory leave

Employees in Belarus are entitled to 24 days of basic annual leave. It is required by law to take at least 14 consecutive days off per labour year, with fines imposed on the employer if leave is not taken. The labour year is based on the employee's start date, not the calendar year.

Pregnancy and maternity leave

Expecting mothers are entitled to 18 weeks (126 days) of paid leave with 100 % pay. This can be increased to 140 days in the case of any medical complications or if two or more kids are born at the same time. Mothers can also access three years of unpaid maternity leave, and the employee’s position must be kept open for this time. The employee can resume work earlier than planned if desired.

Partner/Paternity leave

Unfortunately, fathers and partners have no paid leave entitlements in Belarus. However, 14 days of unpaid leave is available to parents in the first six months after the child’s birth. Therefore it's not a mandatory requirement to pay your employee for this leave, but this is becoming a more common practice for leading companies.

Other leave

Employees receive 80% of their average daily earnings for the first 12 days of general illness or injury.

Employment termination

Termination process

Belarusian employers have the obligation to provide reasons to the employee for termination based on the employee’s conduct at work, business-related economic reasons, and/or the ability of the employee to perform duties at work effectively.

Additional clauses related to termination must be included in the contract between the employee and employer. The contract must cover clauses related to the following scenarios, and what happens when the duration of the contract comes to an end.

Type of terminations:

  • By mutual agreement
  • The fixed term contract’s term naturally expires
  • The employee agrees to be transferred to a different and new position
  • The employee disagrees with moving to a new work location
  • The employee disagrees with new labor conditions or re-organization of the company (often relevant in the event of an acquisition)

If an employment contract is terminated after a probationary period the employer must provide valid and just reason. The notice period must be a minimum of two months unless this is otherwise stated in an agreement.

Notice period

In Belarus, employers must offer a minimum of one-month notice period. The maximum notice period that can be established is three months.

Severance pay

Usually, severance payment details are specified in the employment contract. Generally a default minimum of two weeks of the employee’s average salary is applied.

Probation periods

In Belarus, the maximum probation period is up to three months. In the case of early termination during the probationary period, a minimum of three days’ notice is required.
